A man that had been waiting to travel on a US bound flight when a rucksack fell from an overhead locker is suing British Airways. 45-year-old Wayne Herbert, a writer from north London, said that he suffered severe whiplash injuries after a heavy bag, which was containing a laptop, fell on his head as the plane waited to take off. The Association of Personal Injury Lawyers (APIL) has expressed concern over the Government’s proposed reforms to the system for handling whiplash claims, which will increase the number of road traffic cases heard in the small claims court. The Association of Personal Injury Lawyers (APIL) and Motor Accident Solicitors Society (MASS) have been unsuccessful in their High Court action against the Government, which sought to overturn its decision to reduce legal costs recoverable by people injured in road accidents.
