Most councils have their own criteria for assessing the need to fill potholes. However, budget constraints can play a hand in the maintenance of them. If a council has overlooked a significant pothole that has caused you injury, you may be entitled to claim personal injury compensation from them — if they are liable for the accident.

New figures have revealed that Norwich City Council has been forced to pay out over £50,000 in compensation to nine pedestrians who tripped and fell in Norwich last year. The City Council has defended these claims, saying that a general lack of funding is causing these issues. A council spokesperson said that if the City Hall budgets continue to fall, then pavements would obviously deteriorate as a result. While potholes continue to cause serious injury all over the UK, Kingston Council has recently received seven compensation claims from injured cyclists who blame pothole-damaged roads. Only one of these seven claimants actually received compensation, with £700 going to a cyclist injured on Grafton Road, New Malden, in October of last year. A further six cyclists came forward with injury claims between 2012 and April 2014, however none of them received any compensation. A compensation claim made by the family of a 15-year-old boy who was badly injured in a cycling accident has been rejected. Ollie Pike from Malmesbury, Wiltshire, had been taking part in a charity bike ride in Gloucestershire when his bike hit a pothole, propelling him from his bike. Police have claimed £85million in compensation

Following a Freedom of Information request made by The Sun newspaper, figures have revealed that police officers have claimed £85million in compensation for injuries at work. Accidents ranged from falling in potholes to insect bites, with one individual alone receiving £130,000 for falling and breaking his hip in a store room while on duty.
